The US Wakens to the Demise of their Freedom of Speech



If the US Senate approves President Obamam's nomination of Elena Kagan (pictured) for the US Supreme Court, it will be the end of the First Amendment right of free speech and move the US a giant leap closer to Obama's goal of making the US a socialist nation and becoming America's first dictator, states Newsmax.

Kagan is presently solicitor general, the top government lawyer who argues the administration's cases before the Supreme Court. She supports the idea that it is acceptable for the government to restrict any form of speech if it is deemed to be offensive to society or to the government.

Why would President Obama want to appoint someone to the US Supreme Court who has had no judicial experience whatsoever? Perhaps it has something to do with her undergraduate thesis where she wrote how it saddened her that socialism was declining in America, especially for those that wanted to change America.

It seems Americans are waking up to the eradication of what they believe is the First Amendment which says "Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble and to petition the Government for a redress of grievances". Ms Kagan states: "Whether a given category of speech enjoys First Amendment protection depends upon a categorical balancing of the value of the speech against it's societal costs."

I'm delighted Americans are protesting about the election of Ms Kagan. Here in the UK we know how our freedom of speech has been diminished in the past 13 years, along with other liberties. Good luck to them.

I suggest watching your tendency to swallow far-right US political propaganda hook, line and sinker. You are quoting from a "news source" with an extreme view and little legitimacy. The accusation that she opposes freedom of speech (or for that matter that the Obama administration does) is frankly absurd. Whatever the faults of the Obama administration, and it has some, the destruction of free speech and constitutional protections was the aim of the very people screaming these accusations--the far-right-wing Republicans.

I congratulate her for her refusal to allow military recruitment on the Harvard Law School campus as long as their abhorrent policy of discrimination against gays is in place even though she was forced to rescind the policy later. A voice for equality on the Supreme Court is a good thing.

Receiving support from someone like Newt Gingrich pretty much says it all.

Lets hope the Americans wake up to this a damn sight faster than we did here.

Don't trust socialist politicians, they are very, very economical with the truth, and the rest are no improvement.

As a FYI, there have ALWAYS been limitations on free speech "balancing of the value of the speech against it's societal costs."

It is a very old truism in the US that the 1st Amendment does not give you the right to yell "Fire" in a crowded theater. There have always been laws against slander and libel which also restrict free speech. Speech inciting to riot is restricte. (Our laws are in fact MUCH less restrictive than yours in this regard and Purcell's attorney's would not have been able to threaten our press in a similar situation)

Rosie, the difference in the States is that if they don't like politicians they just shoot them! Sounds good to me.

It appears Newsmax is a very right wing setup Apogee. Haven't noticed that myself but then there are so many American sites that it can be difficult to assess their associations.

We don't have a free press here Jeanne as you must know. That has been corroded over the years with so many newspapers becoming allied to various parties.

Our laws tend to apply to some and not to others as perhaps it is with you.

I wonder, do you have the equivalent of our Human Rights Act? I've been trying to find out this evening or is that covered in your Constitution?

Jing DL, no matter how much I can loathe a politician I'd never encourage such violence. It's the folk who are left behind who suffer the most.

Hi Jeanne,
in the last thirteen years we have gone from a society that could discuss immigration,race,religion and sexual orientation, with out fear of the law. The situation is such that you dare not mention these in public now unless you stick strictly to proscribed "PC" rules or the "thought police" will get you.

We have just had a general election in which none of the main parties would discuss those four subjects. It was quite funny at times watching them all ignore these,especially immigration,very much in the news in your country, although the public very much wanted to discuss this subject.

Very many people in UK would like to discuss the way it has gone here, do you think Arizona could be shut up that way?

Do you wish your own country to be closed down in this way?

Morning Baron. As you know my knowledge of US politics is limited but I did think this was an important issue because of what has happened in recent years over here.

Politics is the same in the West. We have those who are for a government, those against and those who couldn't care less.

Hi Subrosa, this woman is BAD NEWS for America, but sadly, I predict she will be confirmed.
Obummer is stacking the court with commies who will carry out his plan for changing America into a socialist hell hole. I thank you for your good luck wish. We need it.

SR...you certainly hit an excellent and popular subject here...maybe you don't know much about US or Canadian politics but you sure hit the nail on its head with this one. It is a very contentious situation with all that's going on...Government is taking over and they are bankrupting the people - Same here in Canada - a Bunch of commies are already in charge in the US and our opposition parties here want to do the same thing

Bunni, I'm afraid I don't know too much about American politics but when this was brought to my attention by someone I've always respected as 'middle of the road' then I thought it worth mentioning. Especially when Britain has been caught in this very web.
